Salaam,

 

If I am doing taqleed of a certain Mujtahid, is it permissible for me to change the Mujtahid to whom I am doing taqleed? Are there any conditions for this? Or can I change to another Mujtahid because I agree with his opinions or because he seems more learned to me?

Salamun `alaykum wa Rahmatullahi wa Barakatuhu.

The answer is as follows:

 

                                                                 Bismihi Ta`ala

It is impermissible, based on obligatory precaution, to shift in taqlid from an alive mujtahid to another alive one unless the second one is a`lam (more learned than the first one) from the mukallaf's (obligee) point of view and his fatwa (verdict) differs from that of the first mujtahid in this issue in which case it becomes wajib (obligatory), as per obligatory precaution, to shift one's taqlid to the second mujtahid.

Salaam Alaykum

 

The only way you can change Taqleed is when you come to conclusion that the Mujtahid you would like to follow is A'alam or more knoledqeable. However, some Ulama in Hawzah believe that we could follow different Mujtahids in different subjects and issues or chose to follow the most expert in the subject. I don't think any of the living Marja's allow that they all claim to be expert in all issues. Ayatullah Khamenehei, Mutahhari, Montazeri and Ayatullah Shahid Sadr have disscussed or disscussing the possibility of this.

Answer: It is not permissible to change Taqleed except for when an expert (ahle khibra) witnesses that the other Mujtahed is more knowledgeable. { If an ahle khibra witnesses so, it is permissible.)

If a mujtahid is the most learned one , roué must refer to him , but before doing so , study Ayatullah Lankarani's risalah on how to recognize the most learned one. It is necessary to mention , changing ones mujtahid must be based on reason.
